Community based Punishments, in the Context of Islam and the Prevailing Laws of Pakistan

Abstract

Any kind of non-custodial punishment that is carried out with the participation of the community and under the supervision of a government representative is known as community punishment or community sentences. Such punishments are based on the offender's personality, the perpetrator's condition, the offender's background, age, status in society, family, and economic status. Victim consent is also required for these punishments. The Islamic criminal justice system also emphasizes social punishments and similarly, in Pakistan's criminal justice system these punishments have legal status but there is no separate law which deals with social punishments. What are the social punishments in the current laws of Pakistan and what is their status in this research will be examined?

  This research has been analyzed and critically reviewed by the author using various libraries and essays on the subject using libraries and the essayist has come to the conclusion that both Islam and Pakistan's criminal justice system have community-based punishments. But the current Pakistani laws are not enough to enforce these punishments and there is a lot of gap in them.
